No Refunds on Digital Products Is Illegal in the UK -What Every Buyer Needs to Know

Most online sellers claim 'all sales final' on digital products. Under UK law, that policy is void. You have a 14-day right to cancel -and most sellers don't want you to know that.

The Refund Myth That Costs Buyers Millions Every Year

You buy an online course. It is nothing like what was advertised. You ask for a refund. The seller points to their Terms: "All digital sales are final. No refunds."

You assume they are right. You walk away. You lose your money.

But that seller was wrong -and under UK law, their "no refunds" policy was void before you even clicked the buy button.

What the Law Actually Says

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 gives UK consumers a 14-day right to cancel most purchases made online -including digital products.

This right applies to:

  • Online courses and coaching programmes
  • Ebooks and digital guides
  • Software subscriptions
  • Membership sites
  • Digital templates and downloads

The 14-day period begins the day after you purchase. During this window, you are entitled to a full refund -no questions asked -under UK law.

The One Exception Sellers Misuse

There is one legal exception to the 14-day rule for digital products: if the seller provides the digital content immediately and you give express consent to waive your right to cancel before downloading begins.

For this waiver to be legally valid, all of the following must happen:

1. The seller must clearly explain that your cancellation right will be lost once download begins

2. You must actively confirm you understand and accept this

3. The seller must provide written confirmation of your acknowledgement

A buried clause in terms and conditions does not constitute valid waiver. A pre-ticked box does not constitute valid waiver. A general "all sales final" notice does not constitute valid waiver.

If the seller didn't explicitly ask you to waive your cancellation right -and you didn't actively agree -the waiver is invalid and your 14-day right remains intact.

What This Means for Online Courses

Online courses are one of the most common areas where this right is violated.

A course sold via a platform like Kajabi, Teachable or Thinkific typically grants access to the course materials at the point of purchase. Many sellers claim that because you have accessed the content, you have waived your cancellation right.

This is only legal if you were clearly informed of this before purchase and actively agreed to it.

If you were not -you still have your 14-day cancellation right.

Your Rights If a Seller Refuses a Refund

If a UK seller refuses a refund and your 14-day right is intact:

1. Write to the seller formally -state that you are exercising your right to cancel under the Consumer Contracts Regulations 2013, regulation 29, and request a refund within 14 days.

2. Raise a chargeback with your bank or card provider -for purchases made by debit or credit card, your bank can often reverse the transaction. Cite "non-delivery of contracted services" or "misrepresentation."

3. Report to Trading Standards -UK sellers who refuse legal refund rights can be reported to your local Trading Standards authority or to the Citizens Advice consumer helpline (0808 223 1133).

4. File with the CMA -The Competition and Markets Authority accepts reports of businesses that systematically deny consumer rights. Reports can be submitted at gov.uk/report-trading-standards.

The Bigger Picture: Why This Matters

Most buyers never claim the refund they are legally entitled to. Sellers rely on this.

A seller who includes "all sales final" in their terms knows that most buyers will assume they have no recourse. For every buyer who fights back, dozens walk away without the refund they were owed.

This is why Red Flag AI Pro includes a scan for contract contradictions -checking whether a seller's guarantee language conflicts with their actual terms, and whether those terms attempt to remove statutory rights that cannot legally be removed.

Before you buy from any online seller, paste their sales page or terms into Red Flag AI Pro. We will tell you in 60 seconds whether their refund policy is legal -and what your rights actually are.
